Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Aviafares website, mobile applications, phone-booking service, and any related content or services (collectively, the "Services"). By using the Services you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Who we are

Aviafares is a brand and trading name of Fargo Travel Agency, a US-based travel agency with offices at 623 Main Ave. E, West Fargo, ND 58078. We arrange air travel on behalf of our customers. We are not an airline. We act as an agent of the airlines and of the third-party Global Distribution Systems (GDS) and NDC suppliers that provide the air inventory displayed on the site. References to "Aviafares," "we," "us," or "our" in these Terms mean Fargo Travel Agency.

2. Your use of the Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to attempt to gain unauthorized access to the Services, to interfere with their operation, or to use automated systems to extract data without our prior written consent.

3. Booking and payment

When you book a flight through Aviafares, you enter a contract of carriage directly with the operating airline. Aviafares facilitates the booking and handles payment processing, but the airline is the party responsible for performing the flight. All fares, fees, taxes, and currency conversions shown at checkout are final at the moment of purchase.

4. Cancellations and changes

Most airline tickets are subject to the airline's own cancellation and change fees. Those rules take precedence over any Aviafares policy. Where a ticket is refundable or changeable, Aviafares may charge a modest service fee for processing the change on your behalf. See our Refund Policy for details.

5. Disclaimers

The Services are provided "as is" and "as available." Aviafares does not warrant that flight information displayed on the site is complete or error-free, prices, schedules, and availability change in real time and we rely on supplier data. We are not liable for delays, cancellations, or service failures by the operating airline.

6. Limitation of liability

To the maximum extent permitted by law, Aviafares's total liability to you for any claim arising from the Services is limited to the amount you paid to Aviafares (excluding airline fare) for the transaction in question.

7. Governing law

These Terms are governed by the laws of the State of North Dakota, without regard to conflict-of-laws principles. Any dispute must be brought in a court of competent jurisdiction in Cass County, North Dakota, or, where the law permits, in your state of residence.

8. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Effective date" above and, for material changes, post a notice on the homepage or notify registered users by email.
